WUN ("Wat-U-Need") is a Caribbean super-app that connects you with rides, food and parcel delivery, marketplace shopping, and home & professional services, and lets you hold and spend a wallet balance. WUN is operated by 24/7 I.T. of Saint Lucia ("WUN", "we", "us", "our"). These Terms of Service ("Terms") govern your use of the WUN apps, websites, and services (together, the "Platform").
By creating an account, tapping "I agree", or using any part of the Platform, you accept these Terms. If you do not agree, do not use the Platform. Additional terms apply if you sign up to earn on WUN as a driver, courier, or service provider; those supplement, and are read together with, these Terms.
1. Who we are and what WUN does
WUN is a technology platform. For rides, deliveries, and services, WUN acts as an intermediary that connects customers ("Customers", "you") with independent third parties ("Providers") — including drivers, couriers, and service professionals — who supply the transport, delivery, or service. Except where we clearly state otherwise, WUN does not itself provide transport, prepare food, sell marketplace goods, or perform home services. WUN is not the employer, agent, or partner of any Provider, and Providers are not our employees.
2. Eligibility and accounts
- You must be at least 18 years old, or the age of legal majority in your territory, to hold a WUN account and to top up or spend a wallet balance.
- You must provide accurate, current information (including a valid mobile number and, where requested, email) and keep it up to date. We may verify your identity, including through one-time passcodes sent to your phone or email.
- Your account is personal to you. You are responsible for all activity under it and for keeping your device, PIN, and credentials secure. Tell us immediately if you suspect unauthorised use.
- You may not create an account using another person's identity, hold multiple accounts to abuse promotions, or transfer your account to anyone else.
- We may refuse, suspend, or close an account where we reasonably believe there has been fraud, abuse, a safety risk, or a breach of these Terms, or where required by law.
3. The WUN Wallet
The WUN Wallet is a prepaid stored-value feature that lets you hold a balance in Eastern Caribbean dollars (XCD) to pay for services on the Platform. It is a convenience feature, not a bank account.
3.1 Balances and top-ups
- You may add funds ("top up") to your Wallet using the payment methods we make available. Funds are credited once the payment processor confirms settlement.
- Your Wallet balance may only be used to pay for rides, deliveries, marketplace orders, services, fees, and other charges on the Platform. It is not a means of transferring money to other people, and it cannot be used outside the Platform.
- We may set minimum and maximum top-up amounts and a maximum balance, and may apply limits to comply with law or to manage risk.
3.2 No interest
Wallet balances do not earn interest and are not a deposit or investment. We do not pay you any return on funds held in your Wallet.
3.3 Refunds and reversals
- Where a service is cancelled, not delivered, or materially not as described, and you are entitled to a refund under these Terms, we will normally credit the refund to your WUN Wallet.
- Refunds to the original payment method may be available at our discretion or where required by law, and may take several business days to appear.
- We may reverse a Wallet credit that was applied in error, obtained by fraud, or charged back by a card issuer or bank.
3.4 Withdrawals and closing your Wallet
Where withdrawal of a remaining balance is supported, we may require identity verification and may return funds only to a verified account in your name. We may deduct amounts you owe us before returning a balance.
3.5 Dormancy
If your account shows no top-ups, spending, or logins for 24 consecutive months, we may treat your Wallet as dormant. We will attempt to contact you at your registered phone or email before taking action. We may apply a reasonable dormancy administration fee, disclosed in advance, and will handle any remaining balance in accordance with applicable Saint Lucia law, including any requirement to remit unclaimed funds.
4. Booking rides, deliveries, and services
- When you request a ride, delivery, marketplace order, or service, you are making an offer to enter into a contract with the relevant Provider (or merchant), which is accepted when a Provider accepts your request.
- Prices shown may be estimates. Final fares and charges can vary with distance, time, waiting, tolls, demand-based ("surge") pricing, item weight or size, and applicable taxes and fees. Where a price is fixed at booking, we will say so.
- You must provide accurate pickup, drop-off, and service details and be reachable. You must not book any trip, delivery, or service that is unlawful, or ask a Provider to carry prohibited, dangerous, or illegal items.
- Age-restricted goods (for example, alcohol) may only be ordered by, and delivered to, a person of legal age with valid identification. A Provider may refuse to complete a delivery if age or identity cannot be verified.
5. Payments, fees, and taxes
- You authorise us to charge your selected payment method or deduct from your Wallet the total shown for your order, plus any applicable service fee, delivery fee, small-order fee, or government taxes.
- Tips to Providers, where offered, are additional and go to the Provider.
- You are responsible for any charges your bank or card issuer applies. Prices are in XCD unless stated otherwise.
6. Cancellations and no-shows
- You may cancel a request through the app. A cancellation fee may apply if you cancel after a Provider has accepted and is en route, or after a merchant has begun preparing your order.
- If you are not present or reachable at pickup or delivery within a reasonable waiting period, the trip or delivery may be cancelled and a no-show fee may apply.
- Perishable or prepared items that cannot be re-delivered may be non-refundable once prepared, except where the fault lies with the merchant, courier, or WUN.
- Cancellation and waiting-time fees are disclosed in the app and may vary by service and territory.
7. Ratings, reviews, and conduct
You may be asked to rate and review Providers, and Providers may rate you. Ratings help keep the community safe and reliable. You agree to treat Providers, merchants, and our staff with respect, to not discriminate, harass, threaten, or endanger anyone, and to keep vehicles, premises, and goods in reasonable condition. We may restrict or remove accounts that receive serious or repeated complaints.
8. Acceptable use
You must not:
- use the Platform for any unlawful, fraudulent, or harmful purpose, or to transport or deliver prohibited or illegal items;
- interfere with, reverse-engineer, scrape, overload, or attempt to gain unauthorised access to the Platform or its systems;
- impersonate any person, or misrepresent your identity, age, or affiliation;
- use the Platform to send spam, malware, or unlawful content, or to infringe anyone's rights;
- abuse promotions, referral credits, or the refund and dispute processes.
9. Third-party merchants and Providers
Menus, listings, prices, availability, and descriptions from merchants and Providers are their responsibility. WUN is not responsible for the quality, safety, legality, or fitness of goods or services supplied by third parties, except to the extent the law requires or we expressly agree. Issues with an order should first be raised through the app's support and dispute tools.
10. Intellectual property
The Platform, including its software, design, trademarks, and content we provide, belongs to WUN and its licensors. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Platform for its intended personal purpose. You may not copy, modify, distribute, or create derivative works except as permitted by law or with our written consent.
11. Disclaimers
The Platform is provided "as is" and "as available". To the fullest extent permitted by law, we do not warrant that the Platform will be uninterrupted, error-free, or secure, or that any Provider or merchant will meet your expectations. Nothing in these Terms excludes rights you have under mandatory consumer-protection law.
12. Limitation of liability
- To the fullest extent permitted by law, WUN is not liable for the acts, omissions, or conduct of Providers, merchants, or other users, including any injury, loss, or damage arising from a ride, delivery, or service supplied by them.
- We are not liable for indirect, incidental, special, consequential, or punitive losses, or for loss of profits, data, or goodwill.
- Where WUN is found liable, our total aggregate liability to you for any claim is limited to the greater of the total fees you paid to WUN (excluding amounts paid to Providers and merchants) in the three months before the event giving rise to the claim, or XCD 250.
- Nothing in these Terms limits liability that cannot be limited by law, including for death or personal injury caused by our negligence, or for fraud.
13. Indemnity
You agree to indemnify WUN against reasonable claims, losses, and costs arising from your misuse of the Platform, your breach of these Terms, or your violation of law or the rights of others.
14. Dispute resolution
- Support first. Most issues can be resolved quickly through in-app support. Please contact us before taking any formal step, and give us a reasonable opportunity to resolve your concern.
- Good-faith negotiation. If a dispute is not resolved through support, the parties will attempt in good faith to resolve it by negotiation within 30 days of written notice.
- Mediation and courts. If negotiation fails, the dispute may be referred to mediation in Saint Lucia. Subject to any mandatory consumer rights, disputes are otherwise subject to the exclusive jurisdiction of the courts of Saint Lucia.
15. Governing law
These Terms are governed by, and construed in accordance with, the laws of Saint Lucia, without regard to conflict-of-laws principles. Where WUN operates in other Eastern Caribbean territories, additional local terms may apply and, where mandatory local law conflicts with these Terms, that local law prevails for users in that territory.
16. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will give reasonable notice through the app, by email, or by posting the updated Terms with a new "Last updated" date. Your continued use after changes take effect means you accept them. If you do not agree, you should stop using the Platform.
17. Suspension and termination
You may stop using the Platform and close your account at any time, subject to settling amounts owed and any Wallet handling above. We may suspend or terminate your access where you breach these Terms, create a safety or legal risk, or where required by law. Provisions that by their nature should survive termination (including wallet reconciliation, liability limits, and dispute resolution) will survive.
